Notice of Privacy Practices
This Notice of Privacy Practices describes how Blair Family Health may use and disclose your protected health information (PHI) to carry out treatment, payment, or healthcare operations and for other purposes that are permitted or required by law. It also describes your rights to access and control your PHI. PHI is information about you, including demographic information, that may identify you and that relates to your past, present, or future physical or mental health or condition and related healthcare services.
We are required by law to maintain the privacy of your PHI, provide you with this notice of our legal duties and privacy practices with respect to PHI, and follow the terms of the notice that is currently in effect. We reserve the right to change the terms of this notice and to make the new notice provisions effective for all PHI that we maintain. We will post the revised notice on our website and make copies available upon request.
Your Rights Regarding Your Protected Health Information
You have the following rights regarding PHI we maintain about you:
- Right to Inspect and Copy: You have the right to inspect and copy your PHI that is contained in a designated record set for as long as we maintain the PHI. To inspect and copy your PHI, you must submit your request in writing to our Privacy Officer at the address below. We may charge a fee for the costs of copying, mailing, or other supplies associated with your request.
- Right to Amend: If you feel that PHI we have about you is incorrect or incomplete, you may ask us to amend the information. You have the right to request an amendment for as long as the information is kept by or for our clinic.
- Right to an Accounting of Disclosures: You have the right to request an “accounting of disclosures,” which is a list of the disclosures we made of your PHI for purposes other than treatment, payment, healthcare operations, and certain other activities.
- Right to Request Restrictions: You have the right to request a restriction or limitation on the PHI we use or disclose about you for treatment, payment, or healthcare operations. We are not required to agree to your request, but if we do, we will abide by our agreement (except in an emergency).
- Right to Request Confidential Communications: You have the right to request that we communicate with you about medical matters in a certain way or at a certain location.
- Right to a Paper Copy of This Notice: You have the right to a paper copy of this notice.
- Right to Notification of a Breach: You have the right to be notified in the event of a breach of your unsecured PHI.
Uses and Disclosures of Protected Health Information
We may use or disclose your PHI without your authorization for the following purposes:
- Treatment: We may use or disclose your PHI to provide, coordinate, or manage your healthcare and any related services. For example, we may disclose your PHI to a specialist or pharmacy.
- Payment: We may use or disclose your PHI to obtain payment for your healthcare services. For example, we may share information with your health plan.
- Healthcare Operations: We may use or disclose your PHI for our healthcare operations, such as quality assessment, employee review, or legal services.
- As Required by Law: We will disclose PHI when required to do so by federal, state, or local law.
- Public Health Activities: We may disclose PHI for public health activities, such as reporting diseases or adverse events.
- Health Oversight Activities: We may disclose PHI to a health oversight agency for audits, investigations, or inspections.
- Lawsuits and Disputes: If you are involved in a lawsuit or dispute, we may disclose PHI in response to a court or administrative order.
- Law Enforcement: We may release PHI if asked to do so by a law enforcement official in certain circumstances.
- Coroners, Medical Examiners, and Funeral Directors: We may release PHI to assist in identifying a deceased person or determining a cause of death.
- Organ and Tissue Donation: If you are an organ donor, we may release PHI to organizations that handle organ procurement.
- Research: Under certain circumstances, we may use or disclose PHI for research purposes.
- To Avert a Serious Threat to Health or Safety: We may use or disclose PHI to prevent a serious threat to your health and safety or the health and safety of the public or another person.
- Military and Veterans: If you are a member of the armed forces, we may release PHI as required by military command authorities.
- Workers’ Compensation: We may release PHI for workers’ compensation or similar programs.
- Inmates: If you are an inmate, we may release PHI to the correctional institution or law enforcement official.
Other Uses and Disclosures
Any other uses and disclosures will be made only with your written authorization. You may revoke this authorization at any time in writing, except to the extent that we have already taken action in reliance on the authorization.
Changes to This Notice
We reserve the right to change this notice and make the revised notice effective for PHI we already have about you as well as any information we receive in the future. We will post a copy of the current notice on our website with the effective date.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services. To file a complaint with us, please contact us via phone or via email. All complaints must be submitted in writing. You will not be penalized for filing a complaint.
